Poppy TV Terms of Service
Welcome to Poppy TV. These User Terms of Service (hereinafter referred to as these “Terms”) are formulated to help you understand your rights, obligations and applicable usage rules when you use this application and related services.
Before accessing, registering for or using Poppy TV, please read these Terms carefully, especially the sections covering paid services, automatic renewal, user liabilities, breach remedies and limitation of liability.
By accessing or using the products and services provided by Poppy TV, you acknowledge that you have read and agree to abide by these Terms. If you do not agree with any provision herein, please discontinue your use of the services.
If you are under the age of 18 or do not have full capacity for civil conduct, you shall read these Terms under the supervision and guidance of your parent or legal guardian, and pay special attention to the provisions relating to minors. Poppy TV shall not be liable for any adverse consequences arising from registration or use of the services that fail to meet applicable usage requirements, and reserves the right to terminate service provision.
1. Contractual Relationship and Scope of Service Use
1.1 Contracting Parties
These Terms constitute an agreement between you and the operator of Poppy TV governing your use of the products and services.
In these Terms, “Poppy TV”, “we”, “us” or “the Platform” refers to the legal entity responsible for operating Poppy TV; “you” or “user” means any individual accessing or using Poppy TV products and services.
Whether you use all or part of Poppy TV’s features, you shall comply with the provisions of these Terms.
1.2 Principles of Service Use
Unless otherwise expressly agreed between you and Poppy TV, the services provided by the Platform are for your personal, non-commercial use only.
You shall access and use the services only through channels provided or expressly approved by the Platform. The usage rights granted under these Terms are personal to you and may not be assigned to any third party without authorization.
Without prior authorization from Poppy TV, you may not use plugins, third-party software or other technical tools to interfere with, disrupt, modify or otherwise impair the normal operation of the Platform’s services.
The Platform reserves the right to take corresponding measures under these Terms for any violation of the above usage requirements.
2. Devices and Software Required for Services
2.1 Device and Network Requirements
To use Poppy TV, you shall independently prepare a terminal device capable of accessing the relevant services, such as a smartphone, computer or other compatible device.
Any telephone charges, internet access fees and other related expenses incurred during use shall be borne solely by you.
You acknowledge that accessing or running Poppy TV may consume device resources, network bandwidth and other terminal capacity.
2.2 Software License
If downloading software is required to use Poppy TV services, we grant you a personal, non-exclusive, non-transferable license to use such software.
This license permits you to use the software solely for accessing and using Poppy TV services. It does not grant you ownership of the software or any other rights not expressly stated herein.
2.3 Software Updates
Poppy TV may release application updates to improve user experience, maintain service security and ensure consistency across product features.
You shall upgrade the software to the latest version as needed. We do not guarantee that all features will function properly if you continue using an outdated version.
3. Account Usage, Personal Information and Security
3.1 Login Methods and Account Management
Poppy TV allows users to access certain products and services as guests.
To reduce the risk of account loss, we recommend that you log in via Google Sign-In or other login methods supported by the Platform.
When using account-based services, please keep your account information, passwords and other login credentials secure and do not disclose them to others. We recommend that you log out promptly when you finish using the service or step away temporarily.
You shall bear all risks and liabilities arising from account or password compromise due to inadequate safeguarding on your part.
If your account suffers a security incident or unauthorized disclosure of personal privacy that is not caused by Poppy TV’s fault, the Platform shall not be liable for any losses arising out of or related to such incident.
3.2 Management of Personal Profiles
Protecting user personal information is one of Poppy TV’s fundamental principles.
When you access the services via login methods supported by the Platform, we will adopt appropriate information security technologies and administrative procedures to establish information management and protection mechanisms, so as to mitigate the risk of unauthorized access, use or disclosure of your personal information.
You may view and modify the information you submit at any time.
3.3 Restrictions and Exceptions to Information Disclosure
Except with your consent or as otherwise required by applicable laws and regulations, Poppy TV will not disclose your personal information to enterprises, institutions or individuals outside the Platform.
As a general rule, we will not disclose user registration information, non-public content, materials and data stored on the Platform’s servers or databases during online service use to the public or third parties.
However, relevant information may be disclosed in accordance with the law or where necessary in the following circumstances:
- You have expressly permitted Poppy TV to disclose such information in advance;
- Applicable laws and regulations require provision of such materials;
- A government authority or judicial body issues a lawful request or order;
- Disclosure is necessary to safeguard the public interest;
- Measures are necessary to protect the legitimate rights and interests of Poppy TV.
4. Paid Features and VIP Membership Benefits
4.1 VIP Service Content
Poppy TV provides VIP membership services for users.
While your membership is valid, VIP users may access privileges marked with the VIP label within the app free of charge.
If you do not renew your membership within the applicable period, the corresponding VIP benefits will cease upon expiration of your membership.
4.2 Exclusive Nature of Membership Benefits
VIP membership and associated benefits are only available to the paying account and may not be transferred between different Poppy TV accounts.
You may not gift, lend, rent, transfer or sell your VIP membership to others.
If any of the above acts occur, Poppy TV reserves the right to revoke the VIP status and related benefits of the receiving account without prior notice. Any losses arising therefrom shall be borne by the transferor and transferee.
4.3 Pricing and Adjustments
Poppy TV may set pricing standards, price rules and billing methods for different products and features based on actual service conditions.
Pricing may vary across different services, and the same service may adopt different prices or billing rules at different stages.
We may adjust the prices and billing methods of existing paid services, or begin charging for some previously free services.
Relevant pricing standards and rules take effect upon publication and form an integral part of these Terms.
Before adjusting pricing standards, rules or billing methods, we will notify you via in-app notices or announcements on relevant service pages.
If you do not agree to the revised paid terms, you may stop using the relevant services. Continued use constitutes acceptance of the updated pricing standards, rules and billing methods.
4.4 Validity Period for Purchased Content
Poppy TV offers paid viewing and reading services.
For subscribed paid episodes, the service validity period is one month from the date of subscription.
We only guarantee your access to the corresponding paid short dramas during this validity period. Poppy TV shall not be liable for viewing failures or access issues occurring after expiry of this period.
5. Automatic Renewal and Cancellation Rules
5.1 Automatic Renewal Service
Poppy TV offers an automatic renewal feature for VIP membership.
By selecting automatic renewal, you acknowledge and agree to this Section and authorize payment of subsequent subscription fees through the Google Play account linked to your VIP account.
When your current subscription cycle is about to end, the system will automatically deduct the fee for the next cycle in accordance with the applicable subscription rules to renew your membership.
If renewal fails due to insufficient balance in the linked payment account, your VIP membership will expire at the end of the current cycle.
5.2 Automatic Renewal Timing
VIP automatic renewal fees are charged to your Google Play account.
Unless you turn off automatic renewal at least 24 hours before the end of the current subscription cycle, your subscription will renew automatically in accordance with the applicable rules.
5.3 Cancelling Automatic Renewal
You may manually cancel Poppy TV VIP automatic renewal through Google Play.
Steps: Open Google Play; Go to Payments & Subscriptions; Select Subscriptions; Locate Poppy TV in your subscription list; Enter the corresponding VIP subscription item and choose to cancel the subscription.
After automatic renewal is turned off, future charges depend on your subscription status and Google Play’s processing rules.
6. Virtual Currency, Top-Up and Content Purchase Rules
6.1 Scope of Virtual Currency
Some Poppy TV products or services must be purchased using in-app virtual currency.
Different items may require different types of virtual currency. When purchasing items, you must use the virtual currency type specified for that item.
6.2 Restrictions on Virtual Currency Trading
Peer-to-peer trading of virtual currency between users is prohibited on the Platform.
If you trade virtual currency with other Poppy TV users, such conduct constitutes a breach of these Terms.
Poppy TV reserves the right to take appropriate measures to restrict or block peer-to-peer virtual currency transactions on the Platform without prior notice.
6.3 Top-Up Confirmation and User Responsibility
Before completing a virtual currency top-up, please carefully verify the target account, selected package and other required information, and confirm the details before payment.
Once a top-up is completed, you may not request changes or modifications to the transaction.
Poppy TV shall not be liable for any losses caused by operational errors, incorrect account entry, wrong package selection or misunderstanding of the Platform’s charging rules, and you may not claim compensation from Poppy TV for such losses.
6.4 Third-Party Payment Services
If you complete a top-up via a third-party payment provider, you shall also comply with that provider’s terms of service, rules and policies.
During payment, please safeguard your personal information and payment credentials, including bank account details, passwords and verification codes.
Poppy TV shall not be liable for disputes arising out of or related to services provided by third-party payment providers.
6.5 Amount Discrepancies Caused by Platform Malfunction
If a Platform malfunction results in a discrepancy between the amount you actually paid and the amount received or recorded by the Platform, we will handle the discrepancy appropriately once data is restored and you provide valid, lawful proof.
Specifically: If the amount recorded as received by the Platform is less than the amount you paid due to Platform malfunction, we will supplement the difference; If the amount recorded as received by the Platform exceeds the amount you paid due to Platform malfunction, we reserve the right to recover the excess portion.
6.6 Purchased Content and Refund Limitations
You understand and agree that once you complete a short drama subscription on Poppy TV, you may not request changes to that subscription.
Unless otherwise approved by Poppy TV, you may not request a refund of virtual currency spent on subscribed paid stories or short dramas.
Even if the Platform suspends or interrupts services, or a paid short drama is removed from the Platform, virtual currency paid for subscribing to that content will not be refunded.
If your account is suspended or terminated for violating these Terms, you are not entitled to any compensation or indemnification from Poppy TV.
7. Advertisements and Third-Party Services
7.1 Advertisements and Promotional Materials
You understand and agree that in the course of providing services, Poppy TV may display advertisements and promotional content itself or through authorized third-party ad providers.
Such content may include commercial promotions as well as non-commercial messages.
Poppy TV may adjust the delivery channels, formats and coverage of advertisements and promotional materials according to operational needs, and is not required to notify users separately for each adjustment.
7.2 Ad Content and Transaction Risks
Poppy TV will fulfill its advertising-related obligations in accordance with applicable law.
You shall independently judge the authenticity and reliability of ad content and whether the advertised goods or services meet your needs.
If you enter into a transaction with an advertiser or other third party based on ad content, you shall bear all risks and losses arising from such transaction unless otherwise required by law.
Poppy TV shall not be liable for damages arising from ad content or transactions made in reliance on ads, except where applicable law provides otherwise.
7.3 Advertisements within Paid Services
Purchasing Poppy TV paid services or features does not entitle you to an ad-free experience.
Ad serving forms part of the integrated services Poppy TV provides to all users. By reading and accepting these Terms, you acknowledge and consent to this arrangement.
7.4 Rules for Third-Party Products and Services
When you use third-party products or services through Poppy TV, you must comply both with these Terms and the applicable terms of those third parties.
For disputes arising during use, Poppy TV and the relevant third party shall each bear their respective liabilities within the scope permitted by applicable law and their contractual arrangements.
8. Intellectual Property and User Content
8.1 Ownership of Platform and Content Rights
The trademarks used by Poppy TV in providing services are owned by Poppy TV.
Copyrights, trademarks, trade secrets and other intellectual property rights, ownership and legitimate interests in information, materials, text, software, audio, images, videos, graphics and other content associated with Poppy TV services, including the software itself, belong to Poppy TV or the respective rights holders.
Such rights are protected by applicable laws and regulations.
8.2 Restrictions on Unauthorized Use
Unless you obtain lawful authorization from Poppy TV or the relevant rights holder, you may not engage in any of the following activities with respect to the above content: Modifying, copying or reproducing and distributing; Distributing, transmitting or publicly displaying; Publicly performing, remaking or creating derivative works; Authorizing others to use; Transferring, selling or otherwise exploiting without permission.
If you violate these intellectual property requirements, Poppy TV may immediately stop providing relevant services to you, without prejudice to other legal remedies available to the Platform.
You shall also destroy all related information, materials, text, software, audio, images, videos, graphics and other content in your possession.
8.3 Content Submitted or Shared by Users
You are solely responsible for content you send, post or share through Poppy TV, including web pages, text, images, audio, video and graphics.
You must ensure that such content is lawfully sourced, that you hold the relevant rights, or that you have obtained valid authorization from the rights holder.
To perform these Terms and provide services to you, you grant Poppy TV permission to use the content you send or share via the Platform.
8.4 Handling Rights Holder Notifications
If Poppy TV receives a notice from a rights holder alleging that content you have posted or shared infringes their legitimate rights, the Platform may, in its sole discretion, take appropriate measures including deleting, blocking or removing access links to such content.
For serious infringements of intellectual property rights belonging to the Platform or other rights holders, we may take further measures under the breach provisions of these Terms.
9. User Conduct Rules and Liability for Breach
9.1 Requirements for Lawful Use
When using Poppy TV, you shall comply with applicable laws and regulations and respect local social ethics and customs.
You may not use the Platform to engage in illegal or prohibited conduct, including but not limited to: Publishing, disseminating, transmitting or storing content that endangers national security and unity, undermines social stability, violates public order and good morals, as well as insulting, defamatory, pornographic, sexually explicit, violent or other unlawful information; Disseminating or storing content that infringes the intellectual property rights, trade secrets or other legitimate rights of others; Maliciously fabricating facts or concealing the truth to mislead or defraud others; Posting, sending or distributing spam advertisements and other harassing content; Engaging in other activities prohibited by applicable laws and regulations.
You shall also avoid using Poppy TV services to involve the Platform in political or public incidents. Otherwise, the Platform reserves the right to suspend or terminate your service access.
9.2 Platform Handling of Violative Content
If Poppy TV discovers user-posted content that violates these Terms, or receives reports of such violative content from others, the Platform may, in its sole discretion, adopt technical or administrative measures.
Such measures may include: Deleting, blocking or removing violative content; Restricting access to certain service features; Suspending or terminating service provision; Restricting, freezing or terminating account access; Pursuing legal liability as permitted by law.
The Platform will determine the appropriate measure based on the nature and circumstances of the violation.
9.3 User Liability
If you violate applicable laws, local regulations or social ethics, you shall bear all corresponding consequences.
For illegal conduct, relevant state authorities or agencies may initiate legal proceedings, impose fines or adopt other sanctions, and may require Poppy TV to provide necessary assistance.
If your conduct causes harm to a third party, you shall be legally liable; if Poppy TV suffers losses as a result, you shall indemnify Poppy TV.
Poppy TV shall not assume liability for harm caused by a user’s unlawful or violative conduct.
9.4 Material Breach and Further Remedies
Violations of provisions in these Terms relating to service usage restrictions, intellectual property, user conduct or local laws and social norms may constitute material breach.
In the event of material breach, Poppy TV reserves the right to suspend or terminate your access to services and retain all fees already paid as agreed liquidated damages.
If actual losses incurred by the Platform exceed the retained fees, Poppy TV reserves the right to recover the excess amount from you in accordance with the law.
10. Service Risks, Limitation of Liability and Security Notices
10.1 Basis of Service Provision
Poppy TV provides products and features to users on an “as-is” and “as-available” basis, subject to current technical capabilities and available service resources.
We will use reasonable efforts to maintain service continuity and security, but cannot foresee or completely avoid all technical, legal and other risks.
For example, system instability, third-party service failures, malware, cyberattacks, data loss, government action and force majeure events may cause service interruptions or other losses.
10.2 Force Majeure
Force majeure means unforeseeable, insurmountable and unavoidable objective events that materially affect the parties.
Such events may include natural disasters such as floods, earthquakes, pandemics and storms, as well as social events such as war, civil unrest and government action.
If services are interrupted due to force majeure, we will cooperate with relevant parties as soon as practicable and take appropriate remediation measures.
To the fullest extent permitted by law, Poppy TV shall not be liable for losses suffered by users arising from such events.
10.3 Other Causes of Service Interruption
To the extent permitted by applicable law, Poppy TV shall not be liable for service interruptions or anomalies caused by: Damage from viruses, trojans or other malicious programs, and hacking attacks; Malfunctions in user or Poppy TV software, operating systems, hardware or communication lines; User operational errors; Unauthorized use of Platform services by users; Other circumstances beyond Poppy TV’s control or reasonable foreseeability.
10.4 Risks from Online Information and Other Users
You acknowledge that internet services may be affected by third-party information and the conduct of other users.
Poppy TV does not warrant the truthfulness, suitability or legality of online information and shall not be liable for infringement damages arising therefrom.
Potential risks include: Others posting threatening, defamatory, offensive or unlawful content under anonymous or false identities; Mental harm, personal injury or financial loss caused or likely to be caused by misrepresentation, fraud or other conduct of others; Other risks arising from online information dissemination or user conduct.
10.5 Restrictions for Special Uses
Poppy TV services are not designed for use in nuclear facilities, military systems, medical facilities, transportation, communications systems or other critical infrastructure applications.
Poppy TV shall not be liable for personal injury, property damage, environmental harm or other consequences arising from failures of such systems or services in the foregoing critical fields.
10.6 Boundaries of Content Moderation Rights
Under these Terms, Poppy TV has the right to take action against violative or unlawful content.
This moderation right does not impose a continuous monitoring obligation on the Platform for all user conduct, nor does it guarantee that every violation will be detected, identified or addressed in a timely manner.
10.7 Online Transactions and Anti-Fraud Reminders
Please stay vigilant and do not trust unsolicited messages involving loans, password requests or asset transactions online.
Before conducting any money or property-related operation, verify the true identity of the counterparty and observe the anti-fraud security notices provided by Poppy TV.
11. Minor Use and Guardian Responsibilities
11.1 Minor Usage Requirements
Users under the age of 18 are minors and shall read these Terms and use Poppy TV services under the supervision and guidance of a parent or legal guardian.
Users without full capacity for civil conduct shall also receive assistance from a guardian to understand service rules and potential risks.
11.2 Safety Advice for Minors
Minors may have limited ability to recognize, distinguish and protect themselves in online environments and shall pay special attention to potential risks when using internet products.
We advise minors to: Understand the difference between the online world and reality, arrange online time reasonably and avoid over-reliance on the internet that interferes with daily life; Protect personal privacy and safeguard personal information as much as possible; Use the internet appropriately under guardian guidance; Avoid offline meetings initiated by strangers online or involving unlawful content.
11.3 Guidance from Parents, Guardians and Schools
We recommend that parents, legal guardians and schools monitor minor use of Poppy TV and provide necessary online safety education and guidance.
If a guardian considers it appropriate for a minor, especially a child under 10 years old, to use Poppy TV services, the guardian may register an account in their own name and determine whether the Platform’s content and services are suitable for the minor.
Guardians shall provide necessary supervision and guidance over the minor’s use of the services.
12. Service Adjustments, Amendment and Termination of Agreement
12.1 Changes to Service Content
Poppy TV may modify and adjust existing services, or interrupt, suspend or terminate part or all services based on operational needs.
12.2 Grounds for Platform Termination of Service
Poppy TV reserves the right to interrupt or terminate service provision to users without prior notice in the following circumstances: Applicable law requires users to provide true identity information, but the information submitted is untrue, inconsistent with registration details and no reasonable explanation can be provided; The user violates applicable laws and regulations or these Terms; A government authority or judicial body issues a lawful request; Suspension or termination is required for security or other necessary reasons.
12.3 Amendments to these Terms
Poppy TV may revise these User Terms of Service as needed.
You may review the latest version of these Terms on relevant service pages.
Continued use of Poppy TV software or services after an update constitutes acceptance of the revised Terms.
If you do not accept the revised Terms, you must stop using the software and services.
13. Dispute Resolution and Other Provisions
13.1 Governing Law
The formation, validity, performance and interpretation of these Terms are governed by the law of the agreed jurisdiction, excluding its conflict of law rules.
Disputes arising out of or in connection with these Terms shall also be governed by the law of that jurisdiction.
13.2 Dispute Resolution
If a dispute arises between you and Poppy TV, the parties shall first negotiate in good faith.
If negotiation fails, both parties agree to submit the dispute to a competent arbitration institution in the agreed jurisdiction for arbitration.
13.3 Section Headings and Severability
Section headings in these Terms are for reference only and shall not be used to interpret the meaning of any provision.
If any provision of these Terms is found to be invalid or unenforceable, in whole or in part, the remaining provisions shall remain in full force and binding on both parties.
